Terms of Service

By creating an account or using Bosferi, you agree to these terms. If you are accepting on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" below refers to it.

You can create an account yourself, or an organization can invite you to theirs. You are responsible for keeping the information on your account accurate and for activity that happens under it. Tell us right away if you think someone else has accessed it.

You must be at least 18 years old and able to form a binding contract to use Bosferi.

• Keep your sign-in credentials and devices secure.
• Use the product only for lawful, legitimate business purposes.
• Don't attempt to bypass access controls, overload the service, or interfere with other customers' use of it.
• You are responsible for the content your organization stores in Bosferi, such as messages, files and records.
• Files you or your team upload are your responsibility, including making sure they're free of malware before uploading. We don't scan uploaded files for viruses or malware, and we aren't liable for harm caused by a file your organisation uploaded or shared through the product.

Full detail on what's prohibited is in the Acceptable Use Policy, which is part of this agreement.

Paid plans, per-app billing, and add-ons are processed through Stripe. Billing cycles, renewal, taxes, failed payments, and refunds are governed by the Billing Terms, which are incorporated into this agreement.

Bosferi and its licensors own the platform, software, and branding. These terms don't transfer any of that to you. You and your organisation retain ownership of the content you put into the product. We don't claim rights over your data beyond what's needed to provide the service, as described in the Privacy Policy.

Some features work with services we don't control, such as Google sign-in or the social networks you publish to. Your use of those services is governed by their own terms, and we are not responsible for them or for changes they make that affect a feature.

Bosferi is provided on an "as available" basis. We don't offer an uptime guarantee or service-level agreement. Planned maintenance will be communicated in the product where practical.

Your organisation may stop using Bosferi at any time. We may suspend or terminate access for a breach of these terms, of the Acceptable Use Policy, or of applicable law. Where practical, we'll give notice first. What happens to your data after termination is covered in the Privacy Policy's retention section.

Bosferi is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the service will be uninterrupted or error free, or that AI output will be accurate.

To the maximum extent permitted by law, Bosferi is not liable for indirect, incidental, or consequential damages arising from use of the product. Nothing here limits liability that cannot be limited under applicable law.

To the maximum extent permitted by law, our total liability for any claim relating to Bosferi is limited to the amount you paid us in the 12 months before the event that gave rise to the claim, or 100 US dollars if you paid nothing.

If you use Bosferi for business, you agree to defend and indemnify Bosferi LLC against claims, losses and costs, including reasonable legal fees, arising from your content, your breach of these terms or the Acceptable Use Policy, or your violation of the law or of someone else's rights.

These terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles.

Any dispute will be handled by the state or federal courts located in Marion County, Indiana, and you and Bosferi consent to their jurisdiction.

If you use Bosferi as a consumer, nothing in these terms takes away the protections the law of the country where you live gives you, including the right to bring a claim in your local courts.

When we change these terms we update the effective date above. For changes that materially affect your rights, we'll give notice in the product before they take effect.

• These terms, together with the policies they refer to, are the entire agreement between you and Bosferi about the product.
• If a court finds part of these terms unenforceable, the rest stays in effect.
• You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
• We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages at our providers, natural disasters or government action.
